ARTICLE I: PREAMBLE AND JURISDICTIONAL NEXUS

This Privacy Governance Framework ("Policy") describes how Founders Land Group LLC (the "Company", "we", "us", or "our") collects, uses, and discloses your personal information when you visit, use our services, or make a purchase from www.founderslandgroup.com or www.flg.land (collectively, the "Site").

  • I. Jurisdictional Anchor: While the Company is a California entity, you acknowledge that the "Center of Gravity" of all data processing and transactions is the State of Florida. You expressly agree that any dispute regarding data privacy or this Policy shall be resolved exclusively in Putnam County, Florida.
  • II. Binding Nature: By accessing our proprietary "Verified Land" data, technical reports, or Matterport 3D tours, you irrevocably agree to every provision of this Framework.

ARTICLE II: EXHAUSTIVE CATEGORIES OF DATA INGESTION

To provide "Verified Land" Services, we collect personal information from a variety of sources ("Avenues"):

A. Information Collected Directly from You

  • Legal Identifiers: Full legal name, aliases, mailing addresses, phone numbers, and verified email addresses.
  • Transactional Metadata: Billing addresses, payment confirmation tokens, and specific property interest data including APN (Assessor’s Parcel Number) and S-T-R (Section-Township-Range).
  • Vesting Data: Legal entity names (LLCs, Trusts, IRAs) and documentation provided for real estate title vesting and 1099-S reporting.

B. Technical Telemetry (Usage Data & Forensics)

  • Interaction Metadata: We automatically collect click-stream data, time stamps, and your "Dwell Time" and "Gaze Path" within our Matterport 3D Tours and interactive Land-id maps to protect our proprietary media.
  • Precise Geolocation (The 1-Meter Rule): When utilizing our interactive mapping tools on a mobile device, we collect precise GPS/GNSS coordinates and altitude metadata to facilitate on-site boundary verification.

C. Information from Third Parties

  • E-Commerce & Payment: Data from Shopify, Stripe, and PayPal.
  • Geospatial Partners: Information from county assessors, FEMA flood maps, USDA soil surveys (Candler Sand data), and property data aggregators.

ARTICLE III: THE "BANK-GRADE" DATA UTILIZATION DOCTRINE

Pursuant to the Gramm-Leach-Bliley Act (GLBA) standards, we use your Non-Public Personal Information (NPI) through the following avenues:

  • Contractual Fulfillment: Coordinating with Title Companies, Attorneys, and County Clerks for the electronic recording of deeds.
  • Marketing & "Cross-Context" Advertising: We use pixels to show you "Verified Land" opportunities. You waive any claim that this constitutes a "sale" of data under the California Invasion of Privacy Act (CIPA).
  • AI & Algorithmic Decision Support (ADMT): We utilize Artificial Intelligence to synthesize land data. These are "Decision Support Systems" only; we disclaim liability for "Algorithmic Drift."
  • Human-in-the-Loop Override: Per 2026 ADMT standards, you may request a Human Review of any AI-generated technical report by contacting our Data Privacy Officer.

ARTICLE IV: SMS AND INTERSTATE TELEPHONY (TCPA/10DLC)

To comply with TCPA and 10DLC standards:

  • Express Written Consent: Providing your mobile number constitutes "Express Written Consent" to receive automated marketing alerts.
  • The "No-Share" Guarantee: Mobile information will NOT be shared with third parties or affiliates for marketing/promotional purposes. This data is strictly siloed from all other categories.

ARTICLE V: EXHAUSTIVE DISCLOSURE AND "SHADOW" RISKS

  • Cloud Sovereignty: We utilize Tier-1 providers (Shopify, AWS). In the event of an "Upstream Breach," your sole recourse is against that provider; you waive "Negligent Supervision" claims against the Company.
  • OFAC and AML Compliance: We may perform "Know Your Customer" (KYC) forensics to ensure compliance with U.S. Treasury Sanctions. We reserve the right to report suspicious activity to FinCEN without liability.

ARTICLE VI: YOUR SOVEREIGN DATA RIGHTS

Regardless of your state (CA, IL, FL, etc.), you have the following rights:

  • Right to Access / Know: Request a report of data collected.
  • Right to Delete: Request deletion, subject to real estate statutory retention laws (7–10 years for Chain of Title integrity).
  • Global Privacy Control: We honor GPC signals automatically.

ARTICLE VII: MANDATORY ARBITRATION AND VENUE

Any dispute regarding data privacy SHALL be submitted to the American Arbitration Association (AAA). The seat of arbitration is Putnam County, Florida. The prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
